This Privacy Policy explains how Blacktivity (“Blacktivity,” “we,” “us,” “our”) collects, uses, shares, and protects information when you use our website, apps, and services (the “Services”). We are a nonprofit, ad-supported streaming platform. We partner with advertising and measurement providers to deliver, personalize, and measure ads.

By using the Services, you consent to this Policy.

1) Scope & Roles

Blacktivity is the data controller for personal information processed through the Services (except where we act as a processor for creators under separate agreements).

2) Information We Collect

Information you provide:

   •   Account data (name, email, password), profile preferences, communication choices;

   •   Payment/donation details processed by our payment providers;

   •   Communications you send us (support, submissions).

Information collected automatically:

   •   Device and usage data (IP address, device IDs, OS/browser type, app version, language, crash logs, pages viewed, time on page, clicks, streaming behavior, ad interactions);

   •   Cookies and similar technologies (web beacons, SDKs, pixels) to remember preferences, perform analytics, prevent fraud, and deliver/measure ads;

   •   Ad identifiers (e.g., IDFA/AAID) and probabilistic signals for ad delivery, frequency capping, and interest-based advertising.

Information from third parties:

   •   Analytics, ad partners, anti-fraud services, and, where permitted, social logins or referral sources.

3) Cookies & Interest-Based Advertising

We and our partners use cookies/SDKs to operate the Services, measure performance, personalize content, and deliver ads based on your interests. This may include:

   •   Frequency capping, sequencing, attribution, reach/brand-lift measurement;

   •   Cross-device or cross-context linkage, where permitted;

   •   Matching hashed identifiers or ad IDs.

Your choices:

   •   Manage preferences via our Cookie/Consent Manager (link in site footer).

   •   Browser controls: block/delete cookies (may affect functionality).

   •   Mobile ads: reset/limit IDFA/AAID in device settings.

   •   Interest-based ads opt-outs: DAA (optout.aboutads.info),NAI (optout.networkadvertising.org), YourAdChoices apps, and platform settings (e.g., Google Ads Settings).

   •   You can also email privacy@watchblacktivity.com with “Ad Opt-Out” and your device/browser info.

4) How We Use Information

   •   Provide and operate the Services (streaming, accounts, support);

   •   Personalize content and remember settings;

   •   Deliver, tailor, and measure advertising

   •   Analyze and improve performance, security, and user experience;

   •   Prevent fraud, abuse, and enforce Terms;

   •   Communicate with you (service updates, newsletters where permitted);

   •   Comply with legal obligations.

5) Legal Bases (EEA/UK)

Where GDPR/UK GDPR applies, our legal bases include:

   •   Performance of a contract (providing the Services you request);

   •   Legitimate interests (security, analytics, ad-supported operations, anti-fraud);

   •   Consent (non-essential cookies/SDKs, marketing where required);

   •   Legal obligations (tax, compliance).

6) How We Share Information

We share information with:

   •   Service providers (hosting/CDN, analytics, customer support, payment processors, email/SMS);

   •   Advertising & measurement partners to deliver/measure ads and limit frequency;

   •   Creators/rights holders (aggregated or de-identified performance metrics, where appropriate);

   •   Legal and safety (to comply with law, enforce Terms, protect rights/safety);

   •   Business transitions (e.g., merger/transfer of nonprofit assets) as permitted by law.

We do not sell personal information for money; however, certain disclosures for cross-context behavioral advertising may constitute a “sale” or “share” under California law. See “Your Privacy Rights” below to opt out.

7) Data Retention

We retain personal data only as long as necessary for the purposes set out in this Policy (e.g., account lifecycle, legal, tax, and security requirements). Streaming analytics and ad logs are retained for limited periods consistent with operational and regulatory needs.

8) Security

We use administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is 100% secure.

9) International Transfers

If you access the Services outside the U.S., your data may be transferred to the U.S. and other countries with different data-protection laws. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses).

10) Your Privacy Rights

EEA/UK (GDPR): You may have rights to access, correct, delete, restrict/ object to processing, and data portability. You may withdraw consent at any time (does not affect prior processing).

California (CCPA/CPRA) & similar U.S. state laws: You may have rights to know/access, correct, delete, and to opt-out of sale/share of personal information and certain profiling. You also have the right to limit use/disclosure of sensitive personal information (we do not seek to collect SPI for advertising). We will not discriminate against you for exercising rights.

How to exercise:

   •   Use our Privacy Request form or email privacy@watchblacktivity.com with your request, and we will verify and respond as required by law.

   •   To opt out of “sale/share,” use our “Do Not Sell or Share My Personal Information” link in the footer or email us with “Do Not Sell/Share” in the subject.

   •   Cookie/ads preferences can be managed via the Consent Manager and industry tools listed above.

11) Children’s Privacy

The Services are not directed to persons under 17. We do not knowingly collect personal information from persons under 17. If you believe a child provided personal data, contact privacy@watchblacktivity.com and we will delete it.

12) Do Not Track

We currently do not respond to Do Not Track (DNT) signals. Use the choices in Section 3 and 10 for ad/privacy controls.

13) Changes to this Policy

We may update this Policy. The “Last Updated” date will reflect changes. Material changes will be highlighted or otherwise communicated as required.
